What is a Whiplash Injury and Why Are They So Common with Rear End Collisions?

When one hears the term whiplash, an image may come to mind of a client in a neck brace, sitting in a courtroom with his lawyer, claiming debilitating pain and suffering from a rear end collision. The term has, for a long time, been connected to unscrupulous legal claims, so much that many personal injury attorneys avoid the term entirely, replacing it with hyperextension or cervical strain or sprain. Regardless of what it is called, whiplash and the pain associated with it, is a very real condition as any victim will testify.

Why Whiplash Injuries Happen

It is a misconception that whiplash has been virtually eliminated by the inclusion of vehicular head restraints. In fact, the number of rear end collisions has increased in recent years as a direct result of the number of distracted drivers, resulting in more whiplash injuries. Per recent statistics, rear end collisions are the most common type of accident in California and across the country, accounting from 28% of all accidents. This figure is expected to drop as smart braking technology in integrated into new motor vehicles.

The most common causes of rear end accidents:

· Distracted driving

· Following too closely

· Speeding

When the body is suddenly shoved from behind causing the head to snap backwards and then forward, like snapping a whip, injury to the soft tissue of the neck will often result. While the most common cause of these injuries is car accidents, they may also happen in contact sports and from child abuse, like shaken baby syndrome, as well as slip and fall accidents. In car accidents, whiplash occurs most frequently in low impact, rear end collisions as opposed to high impact. When high impact neck injures do occur, traumatic brain injury may also result from the brain slamming against the inside of the skull. The severe neck pain from the whiplash injury may divert attention away from the possibility of a traumatic brain injury. Even if there are no symptoms, it is important to have a complete evaluation by a medical professional following any impact accident.

Symptoms of Injury to Cervical Soft Tissue

Medical evaluation and treatment should be sought by any person involved in a car crash. A whiplash injury may show no symptoms for several days. If you were in a rear end accident and released from care following an examination, it is important to remain cognizant for future signs. Additional medical attention should be sought immediately to avoid serious complications.

The symptoms from a whiplash injury may include:

· Mild to severe neck pain

· Stiffness or diminished range of motion

· Headaches

· Dizziness

· Pain extending to the back, shoulder or arm

· Burning sensations, numbness or pins and needles to the arms or hands.

· Loss of cognitive abilities, difficulty concentrating

· Sleeplessness

If you are jarred from your seat, even if only slightly, you should seek medical attention immediately then closely monitor your condition following release. Any sign of the condition worsening should be immediately reported to the doctor. This is important not only to prevent future complications but to support any claim against another party.

Injured in a Rear End Collison?

If a distracted, speeding or tailgating driver, struck you from behind, be sure to get a copy of the police report as soon as possible. Refrain from giving any statement to an insurance investigator prior to speaking with an attorney. Even a low impact rear end collision can cause neck and back injuries. A high impact collision can cause a traumatic brain injury. If you suffered any injury, there may be grounds for collecting compensation for medical bills, lost income as well as pain and suffering.
